Terms of Service

By creating an account or using VideoBud (videobud.io), operated by Archieboy Holdings, LLC ("we," "us," "VideoBud"), you ("you," "customer") agree to these Terms of Service. If you don't agree, don't use the service.

1. Service description

VideoBud generates promotional, how-to, and onboarding videos for websites and SaaS applications. The service operates in three modes:

  • Marketing-page walks (public). VideoBud opens public URLs you submit in a headless browser, captures viewport screenshots at multiple scroll positions, and uses those frames to generate a video.
  • Live-demo walks (authenticated). If you provide credentials for a third-party application, VideoBud logs into that application and an AI agent walks the authenticated interface, taking screenshots as it goes. Captured screens may contain whatever real data is in your account at the moment of capture (project names, contact lists, billing screens, etc.).
  • YouTube auto-upload (admin only). Connecting a YouTube account via OAuth allows VideoBud to upload finished videos directly to your channel.

2. Credentials & authenticated browsing

How we handle credentials you provide for live demos:

  • Credentials are pushed to an in-memory vault at intake submission, then atomically popped by the discovery worker when it needs them. Each vault_pop call removes them.
  • Credentials are never written to disk, never logged, never sent to any third party, and never persisted in the database.
  • Tracebacks emitted by the discovery worker redact any substring matching the provided username or password before they're recorded.
  • After a discovery run finishes (success or failure), the vault entry is gone. Re-rendering an existing project requires re-entering credentials through the intake form.
  • The headless browser session that uses the credentials is destroyed at the end of each walk. Cookies it received are not persisted.

You represent that:

  • You're authorized to access the application(s) you point VideoBud at, either as the account holder or under a documented authorization from the account holder.
  • Doing so does not violate the third-party application's terms of service. You accept sole responsibility for any breach of a third party's terms resulting from your use of VideoBud.
  • You will not provide credentials for systems containing data you are not authorized to process or display (see Acceptable Use).

3. Captured screen content & ownership

Screenshots and rendered videos generated from your projects belong to you. You grant VideoBud a non-exclusive license to store, process, and serve them solely to operate the service for you (run discovery, render, host public links you opt into, generate analytics, support requests). We do not use your captured screens or output videos to train AI models.

You are responsible for what appears in your screenshots. If your live-demo walks surface PII, customer data, internal pricing, or confidential information, that content will appear in the rendered video. We recommend using a sanitized demo account for live-demo videos you plan to publish.

4. Prohibited / regulated data

You may not submit, or point VideoBud at, applications containing:

  • Protected health information ("PHI") subject to HIPAA, unless you have executed a separate Business Associate Agreement with us (we do not currently offer one).
  • Payment card numbers, CVV codes, or full bank account credentials in a form that would create PCI-DSS scope.
  • Government-classified information or data subject to ITAR / EAR controls.
  • Personal data of EU/UK residents under conditions that would require a Data Processing Addendum unless one has been executed.

Submitting such data, or directing the agent into areas that contain such data, breaches these terms and may result in account suspension without refund. You are solely responsible for the content of your captures.

5. Acceptable use

You may not use VideoBud to:

  • Generate content that is deceptive, defamatory, harassing, hateful, sexually explicit involving minors, or that promotes illegal activity.
  • Infringe third-party intellectual property, trademarks, or publicity rights.
  • Walk applications you don't own or aren't authorized to access (including web scraping for competitive intelligence in ways prohibited by the target's ToS).
  • Generate fake testimonial / endorsement videos misrepresenting real people.
  • Submit content that violates applicable law (US federal/state, or the law of your jurisdiction).
  • Attempt to reverse engineer, decompile, or circumvent service-level rate limits, watermarks, or paywall enforcement.
  • Use the service to spam, send unsolicited bulk video, or impersonate brands or individuals.

Accounts in violation may be suspended immediately, with no refund of unused portion of the current billing period.

6. Hosting & takedown

Starter+ accounts can host rendered videos at public URLs (videobud.io/v/<slug>) and embed them on third-party sites. Hosting is contingent on:

  • Continued active subscription. If your subscription lapses, public URLs may become unavailable.
  • The video not violating Acceptable Use. We reserve the right to take down any hosted video at our discretion.
  • Responding to DMCA notices. We follow the DMCA safe harbor process; send notices to dmca@videobud.io.

7. Plans, billing & credits

  • "Credits" represent rendered minutes of finished video, replenished monthly on your billing anniversary. Unused credits do not roll over.
  • Storyboard draft previews are unlimited and do not consume credits.
  • Final renders consume credits at 1 credit per minute of rendered output, rounded up.
  • Subscriptions renew automatically until you cancel from the account page. Cancellation takes effect at the end of the current billing period; no proration is issued on cancellation.
  • Refunds are issued at our discretion, generally within 14 days of charge, if the service was substantially unable to provide what was paid for. We do not refund for "didn't use it" cases.
  • Annual plans are billed up front. Switching from annual to monthly mid-term does not refund the unused portion.

8. Data deletion

Deleting a project from your dashboard removes:

  • The project row in our database (cascade-deleting all scenes, source frames, render jobs, view records, and discovery runs).
  • The on-disk project directory under /static/projects/<project_id>/ — frames, audio, intermediate renders, and final renders.

This deletion is immediate and irreversible. Any public/embed links from hosted renders in that project return 404 immediately.

Deleting your entire account removes all projects, all rendered videos, your user record, and any stored OAuth refresh tokens (YouTube, Google). Billing records are retained per US tax-reporting requirements (typically 7 years) but contain no project content.

9. Service availability & SLA

The service is provided on a best-effort basis without an uptime SLA on self-serve plans. We aim for 99.5% monthly uptime exclusive of scheduled maintenance, third-party outages (Stripe, Google Gemini, Anthropic, AWS), and customer-caused incidents. Planned maintenance is announced in advance via the /updates page.

10. Liability

THE SERVICE IS PROVIDED "AS IS." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARCHIEBOY HOLDINGS, LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT WILL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUES, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You will indemnify and hold harmless Archieboy Holdings, LLC from any claim arising from: (a) content you submitted or that was captured from applications you authorized us to walk; (b) your violation of these Terms; (c) your violation of any third party's rights (including IP, privacy, or third-party ToS).

12. Termination

You may terminate at any time by deleting your account. We may suspend or terminate accounts for breach of these Terms, fraudulent billing activity, or extended inactivity (after notice). Sections 3, 4, 5, 10, 11, and 13 survive termination.

13. Governing law & disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Middlesex County, Massachusetts, and you consent to personal jurisdiction there.

14. Changes

We may update these Terms from time to time. Material changes will be announced via email to your account address at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
